Stay on Track: Payments, Defaults & Repossession

We Give You the Keys. You Keep the Commitment.

At Orozco Auto Sales, we believe successful vehicle financing begins with clear expectations and open communication.

Our Buy Here Pay Here program provides qualifying customers with an opportunity to finance directly through our dealership.

With that opportunity comes an important responsibility: making scheduled payments, maintaining required insurance, and following the terms of your signed financing agreement.

We understand that unexpected financial challenges happen. That's why we encourage customers to contact us before an overdue payment becomes a larger concern.

A Friendly Reminder From Our Family

We Help You Get Behind the Wheel — But Miss Your Payments, and You Might Be Back on Your Feet!

All jokes aside, our goal is to help customers maintain successful financing agreements, not to repossess vehicles.

We believe in giving customers clear information, reasonable opportunities to address payment difficulties, and respectful communication.

At the same time, financing agreements create obligations that must be honored.

A Little Communication Today May Help Prevent a Bigger Problem Tomorrow.

Understanding Our Standard Payment Policies

Know Your Dates. Know Your Responsibilities.

Our standard in-house payment policies generally include:

  • Payment Due Date: Payments are due according to the schedule in your signed agreement.

  • Five-Day Grace Period: Our standard policy provides a five-day grace period.

  • $30 Late Fee: A $30 late fee generally applies beginning on the sixth day after the due date, as permitted by the agreement and applicable law.

  • 10-Day Payment-Default Threshold: An account may be considered in default when a scheduled payment becomes 10 days past due, subject to the agreement and applicable law.

The grace period does not automatically change your original due date.

Other contractual events, including failure to maintain required insurance, may constitute default independently of the 10-day payment threshold.

We Provide Time to Address Overdue Payments, but That Time Doesn't Eliminate the Obligation to Pay.

What if I Miss a Payment?

Don't Ignore the Situation. Contact Us.

If a payment becomes overdue, our team may attempt to contact you using permitted communication methods.

We encourage customers to respond promptly, even when they cannot make the full payment immediately.

Depending on the circumstances, management may consider:

  • Reviewing the account and outstanding amount.

  • Discussing available payment arrangements.

  • Considering an extension or modification when appropriate.

  • Explaining the steps needed to bring the account current.

Any special arrangement requires management approval and appropriate documentation.

Extensions and payment accommodations are not guaranteed. Contacting us does not automatically suspend collection activity or repossession rights.

Required Vehicle Insurance

Protecting Your Vehicle Is Part of Your Agreement.

Our standard in-house financing program requires customers to maintain qualifying vehicle insurance.

Requirements include applicable liability coverage, comprehensive coverage, collision coverage, and $500 comprehensive and collision deductibles.

If your coverage expires, is canceled, or changes, contact our dealership promptly.

Failure to maintain required coverage may constitute default under your financing agreement.

Understanding Vehicle Repossession

What Happens After Default?

A vehicle financed through a secured retail installment contract serves as collateral for the financing obligation.

Following default, the secured creditor may have the right to repossess the vehicle in accordance with the agreement and applicable law.

Under Arizona Revised Statutes § 47-9609, repossession may occur through judicial process or, when legally permitted, without judicial process if conducted without a breach of the peace.

Depending on the circumstances and applicable law, advance notice may not be required before repossession.

Our Preference Is a Successful Payment Agreement, Not a Repossessed Vehicle.

Can Repossession Be Avoided?

Early Communication May Create More Options.

If you anticipate difficulty making a payment, contact us as early as possible.

Management may review your situation and consider an available arrangement.

However, no extension, payment modification, or repossession postponement is guaranteed.

Any approved agreement should be documented in writing.

Customers should not assume that a telephone conversation or partial payment automatically changes the original contract terms.

Voluntary Vehicle Surrender

When Keeping the Vehicle Is No Longer Possible.

If you can no longer maintain your financing obligations, you may contact our dealership to discuss voluntarily returning the vehicle.

Voluntary surrender can provide a coordinated alternative to involuntary repossession.

However, returning the vehicle does not automatically cancel the financing agreement or eliminate any remaining debt.

Any outstanding financial obligations will be determined according to the agreement and applicable law.

What Happens After Repossession?

Understanding the Next Steps.

After repossession, a vehicle may be sold or otherwise disposed of as permitted by law.

Customers may have rights involving:

  • Required notices.

  • Redemption of the vehicle.

  • The disposition of the collateral.

  • Application of sale proceeds.

  • Accounting for a deficiency or surplus.

Depending on the circumstances, a customer may still owe a legally recoverable deficiency balance after disposition.

Any surplus must be handled as required by law.

Customers should contact our dealership for account-specific information and applicable next steps.

Personal Belongings in a Repossessed Vehicle

Your Personal Property Matters.

If your vehicle has been repossessed and personal belongings remain inside, contact our dealership promptly.

Our team can explain the available process for identifying and arranging retrieval of personal property.

Personal belongings will be handled in accordance with applicable law and the circumstances of the repossession.

Frequently Asked Questions

Can I pay during the five-day grace period?

Our standard policy provides a five-day grace period. Your original payment due date remains the date specified in your agreement unless properly modified.

What happens on the sixth day?

A $30 late fee generally applies beginning on the sixth day after the payment due date, subject to your agreement and applicable law.

What happens when I'm 10 days late?

Under our standard policy, the account may be considered in payment default, potentially allowing collection activity and other legally permitted remedies.

Can I request more time?

You may contact our team to discuss your situation. Extensions or special arrangements require approval and are not guaranteed.

Can my vehicle be repossessed without warning?

Depending on the circumstances, applicable agreement, and law, repossession may occur without advance notice following default.

Does voluntary surrender eliminate the balance?

Not necessarily. A legally recoverable deficiency may remain after the vehicle is disposed of and proceeds are applied.

What should I do if I'm struggling financially?

Contact our dealership promptly to discuss your account and ask about any available options.
